Building a fence takes a lot of planning, but before you dig that first post hole, you need to ask yourself: Do I need a permit to build a fence?
The answer isn’t always cut-and-dry—it depends on a number of factors, such as:
- Where you live
- What kind of fence you’re building
- The rules that apply to your property
Let’s dig a little deeper.
Know The Rules Before You Start
In most areas, a basic fence along your property line doesn’t require a permit. However, many towns and counties have exceptions. For example, a fence used for safety, like around a pool, or one that exceeds a certain height, often requires approval.
Check your local building codes and neighborhood ordinances to learn what’s allowed. Otherwise, you run the risk of costly fines, stop-work orders or even having to remove your new fence entirely.
Property Lines Matter More Than You Think
Even if a permit isn’t required, you’ll need to know exactly where your property ends and your neighbor’s begins—just a few inches of error can cause major disputes later. Hiring a licensed surveyor to confirm boundary lines is a wise step to protect your investment and keep the peace with neighbors.
Don’t Forget Zoning & HOA Guidelines
Some neighborhoods or jurisdictions have restrictions on the type of fence you can build. For example, corner lots may have limitations on the height or style of your fence to ensure they don’t block drivers’ views. Many neighborhoods with homeowners’ associations (HOAs) have their own rules. Before you buy materials, be sure to confirm both zoning laws and HOA guidelines so your fence is fully compliant.
Albemarle County Has Simplified Fence Permits Applications
If you’re planning for a new fence in Albemarle County, VA, you’re in luck. The County recently launched an online portal to answer the common question: “Do I need a permit for that?” Residents can use the portal to easily apply for permits, check the status and more. According to the portal, fences built specifically for pedestrian safety or used as barriers for swimming pools require a permit.

Dutch Way came this morning to begin the process of our vinyl fence. They have been extremely polite and easy to work with, knowledgable, patient and professional as we changed our minds a few times about what we wanted. Our fence posts are just starting to be put in, but I would already highly recommend them! Can’t wait to see the finished product.
